Civil and Commercial Litigation

Resolving controversies involving our clients is a major element of our practice of law. Rich Rosenthal attorneys handle a wide variety of different kinds of disputes in federal and state courts in Virginia, the District of Columbia, and elsewhere. Whether it is a commercial or personal matter, we are committed to solving problems for our clients in a manner that is prompt, fair, and effective. Below we offer a description of our more common areas of litigation.

Commercial Litigation
Rich Rosenthal represents clients in all manner of business difficulties that concern individuals, sole proprietorships, partnerships, and corporations. We regularly handle cases ranging from large, complex multi-party claims to straightforward landlord-tenant disputes. We appear before all federal and state trial and appellate courts in Northern Virginia, as well as city, county, and state regulatory agencies and boards. Throughout the years, we have represented both plaintiffs and defendants in all manner of commercial cases, including construction disputes, employment claims, breach of contract matters, and insurance claims. We are sensitive that a trial is not the only way to resolve a dispute. With our clients’ ultimate objective in mind, we explore the advantages and the disadvantages of litigation, as well as various forms of alternative dispute resolution, including mediation and arbitration. Our goal is to provide timely and cost effective solutions to the problems that our clients face.

Creditor/Debt Collection
Rich Rosenthal can help individuals and businesses with problems of debt and insolvency. Federal and state laws, along with contractual provisions, define and limit the remedies available to creditors. Some formerly common collection practices are now illegal under the federal Fair Debt Collection Practices Act . Other laws regulate the collection, maintenance, and dissemination of consumer credit information. Sets of laws of each state, as well as the United States Bankruptcy Code, spell out varying provisions and procedures for administering the property and obligations of insolvent debtors. Exemptions, garnishments, attachments, property liens, priorities, and preferences, as well as fraudulent conveyances are also the subject of both state and federal laws.

Rich Rosenthal represents creditors—private and commercial ones—in the legal collection of just debts. We handle complex litigation involving debt and insolvency in state, federal and bankruptcy courts. We are committed to getting prompt, fair, and effective results for our clients.

Personal Injury
If you or a loved one is injured in an accident, you may need professional legal advice and representation to receive the benefits and compensation you deserve. That is where we can help. Rich Rosenthal attorneys have decades of experience providing personalized legal attention and obtaining fair compensation for clients injured in industrial, commercial or traffic accidents . Rich Rosenthal has obtained recoveries for clients for injuries incurred on the job, in motor vehicle accidents, due to slips and falls, from defective products, from assaults or other criminal actions, arising from unsafe premises, or in a host of other circumstances based on the legal fault of another party.

While assisting clients in coordinating and processing appropriate insurance coverage and other available benefits, we prepare to establish a legal basis for recovery of personal injury damages. We strive for out-of-court settlements whenever feasible, and we emphasize the benefits of alternative dispute resolution methods, such as mediation and arbitration. If and when such efforts for compromise prove inadequate to produce a fair result, we are ready, willing, and able to proceed to trial in order to obtain just compensation for our clients. Rich Rosenthal attorneys have been involved in hundreds of trials and settlements involving substantial awards, including several of six or seven figures. We offer free initial consultations for personal injury cases, and our fees are ordinarily contingent on the success of our efforts.
